D. Data collection

This pde website collects a series of data and information every time the website is accessed, which is stored in log files on the server. This may include:

3) the website from which you were referred to us,

E. Registration on our Website

G. Subscribing to our newsletter

On our website, users are given the opportunity to subscribe to our newsletter. We inform our customers and business partners at regular intervals by means of newsletters or information updates about our offers. In the course of registration, we collect your name and email address. Further data like your telephone number and company are optional and only required if you wish to be contacted by us in the future. 

To secure the website against automated attacks, the registration is secured with the service “FriendlyCaptcha”, operated by Friendly Captcha GmbH, Am Anger 3-5, 82237 Woerthsee, Germany. This ensures that the entry is made by a natural person. The legal basis for the security is our legitimate interest in the secure operation of our website. 

After your registration, a confirmation email is sent to the registered email address using the double opt-in method. This confirmation email serves to ensure that you, as the owner of the email address, have actually authorized the receipt of the newsletter and have consented to it in accordance with Art. 6 (1)a GDPR.
By subscribing to the newsletter on our website, your email address, the IP address assigned by your internet service provider, as well as the date and time of registration are stored. In principle, this data is not passed on to third parties, unless there is a legal obligation to pass it on or the passing on serves the purpose of criminal prosecution.

The sent messages contain a tracking pixel, which helps us to note the successful receipt and opening of the sent messages and to work on the basis of our legitimate interest in improving the range we offer. 

You can avoid calling up the tracking pixel if you do not load the graphics from the mail sent and only call up the text version.
For technical reasons, the receipt of our mailings cannot be separated from the sending of the tracking pixel.

H. Sending publications

Our publications (magazine and e-paper) focus on national and international projects as well as sharing knowledge and experiences from all areas of the construction industry. The publications provide readers with a holistic view of the complex challenges and innovative solutions along the construction industry value chain. Another special feature: the articles are written by our experts themselves. For the delivery of the current publication, we need to process the name, address, and, for electronic delivery, the email address of the recipient.

The legal basis for this is either your consent or our legitimate interest in informing recipients about current topics in the construction industry. If you wish to stop receiving our publications in the future, please inform us briefly at datenschutz@porr.at or by snail mail to the address provided under (C.). In this case, we will delete your contact details from this processing and stop any further mailings.

I. Photography and videos at events

As part of our events, photo and video recordings are created, which are subsequently used for publication on websites, in social media channels as well as in our publications and other print media. We want to use it to promote our products and events, as well as the company itself, and to raise awareness in the construction industry.

The legal basis for this is our legitimate interest in public relations work and presentation of the activities of the controller based on Article 6 (1) (f) GDPR.
If you do not agree to photo or video recordings in the context of our events, please contact a representative of our company during the event.We have carefully weighed up the interests of data subjects and our company in this processing and are convinced that we do not violate any rights of data subjects. Of course, you still have the right to object to the processing of the photo and video recordings made. Please simply send an e-mail with a short description of the objection to datenschutz@porr.at.

J. Customer management system

When you use our products or subscribe to information channels, we record your data and preferences in our customer management system. 

Any objections to advertising measures are also stored there to ensure that you do not receive any mailings that go against your interests.

 
This data is not forwarded to third parties. IT service providers with whom a contract has been concluded in accordance with Art. 28 GDPR support us in operating the system. 

K. Contact Option via the website

Due to legal requirements, our website contains information for uncomplicated contact. If you contact us by email, the data you provide will be automatically stored and used exclusively for responding to your contact.

If you use a contact form on our websites, we collect the following data from you:

3) Right to Erasure

Every data subject has the right to obtain from the controller the erasure of personal data concerning them without undue delay where one of the following grounds applies:

  • The personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed.
  • The legal basis for the processing is no longer valid (end of contract, withdrawal of consent).

4) Right to Restriction of Processing

  • You can contact an employee at any time, especially electronically at datenschutz@porr.at, to request the restriction of your data stored with us.

5) Right to Data Portability

Every data subject has the right to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format, and have the right to transmit those data to another controller without hindrance from the controller to which the personal data has been provided, where the processing is based on consent or on a contract and is carried out by automated means.

6) Right to Object

Every data subject affected by the processing of personal data has the right to object, on grounds relating to their particular situation, at any time to the processing of personal data concerning them which is based on legitimate interest. pde will no longer process the personal data in the event of an objection unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defense of legal claims.

7) Automated Individual Decision-Making, Including Profiling

As a responsible company, we do not use automatic decision-making or profiling.

9) Right to Lodge a Complaint with a Supervisory Authority

You have the right to lodge a complaint with a supervisory authority pursuant to Article 77 of the GDPR if you believe that the processing of personal data concerning you violates the GDPR.

N. Data Protection for Applications and the Application Process

pde collects and processes the personal data of applicants for the purpose of handling the application process. Processing can also be carried out electronically. This is particularly the case if an applicant submits the corresponding application documents electronically, for example, by email or via the career portal karriere.porr.at. If pde concludes an employment contract with an applicant, the submitted data will be stored for the purpose of implementing the employment relationship. If pde does not conclude an employment contract with the applicant, the application documents will be automatically deleted no later than thirteen months after receipt of the application, provided that no other legitimate interests of pde or the applicant's consent to further processing oppose the deletion.

If an applicant exercises their right to deletion, the data can be deleted after seven months.

If you apply via our career portal for a specific position, your data will be collected for this position. If you apply without a specific position in mind (speculative application), your data may be forwarded to other companies within the PORR Group based on your qualifications.

O. Further Processing on the Homepage

1. Google Analytics

We use the online advertising program Google Ads from Google and, within this context, Google Conversion Tracking. pde has integrated the Shariff component on this website. The Shariff component provides social media buttons that comply with data protection. Shariff was developed by specialists working for the German computer magazine c't and is being published by GitHub, Inc. The component's developers are GitHub, Inc., 88 Colin P. Kelly Junior Street, San Francisco, CA 94107, USA.

Typically, the social media buttons provided by the social networks transfer personal data to the respective social network when a user visits a website in which a social media button has been integrated. By using the Shariff component, personal data is only transmitted to social networks when the visitor actively presses one of the social media buttons. The use of the Shariff component aims to protect the personal data of visitors to our website and to enable us to integrate a button solution for social networks on this website.

8. Consent Management with CCM19

Our website utilizes the cookie consent technology provided by our data processor CCM19, Papoo Software & Media GmbH, Auguststr. 4, 53229 Bonn, to obtain your voluntary and informed consent or withdrawal for storing certain cookies in your browser and to document this in compliance with data protection regulations.

pde has integrated kununu components on this website. kununu is currently the largest employer rating platform in Europe with over 2.4 million ratings for more than 650,000 companies. The operating company of kununu is kununu GmbH, a subsidiary of XING SE, Dammtorstraße 30, 20354 Hamburg, Germany. Each time one of the individual pages of this website operated by PORR AG on which a kununu component has been integrated is called up, the internet browser on the information technology system of the data subject is automatically caused by the respective kununu component to download a representation of the corresponding kununu component from kununu. Within the scope of this technical procedure, kununu receives information about which specific subpage of our website the data subject visits.
